Government’s proposal to increase number of Temporary Event Notices

On 10th September 2026 the Minister of State at the Home Office laid before Parliament the Licensing Act 2003 (Permitted Temporary Activities) (Amendment) Order 2026

Sarah Jones, Minister of State laid before Parliament the Licensing Act 2003 (Permitted Temporary Activities) (Amendment) Order 2026. This Order will increase the number of Temporary Event Notices (TENS) that may be given in respect of a single premises.

Currently a single premises is permitted to have a maximum of 15 TENS per calendar year and a maximum of 21 days. The Order proposes for this to be increased to 20 TENS and 26 days per calendar year.

To support the hospitality sector during the COVID-19 pandemic, the permitted number of TENS and days were increased on a temporary basis in 2022 and 2023. Due to the benefits seen during these periods, the Government are therefore looking to reintroduce this permanently.

In the written statement to Parliament, Sarah Jones confirmed that this proposal forms part of the Government’s wider approach to supporting vibrant high streets and communities. This is certainly a welcomed change and one which we hope receives approval.

Subject to Parliamentary approval, this Order is planned to come into force on 1 January 2027.
