Do I include staff and performers in my head count?

Q: Is the 200 limit under the Live Music Act the same as for TENs, where you have to include staff and performers? This was raised by a Licensing Officer recently at a gig at my venue when he said that my bar staff and door team took the numbers beyond 200.

A: No, unlike TENs the limit under the Live Music Act relates only to the members of the audience, and does not include bar staff, security staff or performers. Remember also that this limit of 200 on the audience numbers is due to increase to 500 on 6 April 2015.
