Date Announced for Commencement of Changes to the Licensing Act 2003

“The Policing and Crime 2017 (Commencement Number 1 and Transitional Provisions) Regulations 2017 has been made, which means that the following changes will now take place on 6th April 2017:

  • There will be a single appeal on 48 hours’ notice against Interim Steps for the Premises Licence Holder, unless there has been a material change in circumstances;
  • There is a provision now for the Licensing Authority at the hearing of the full review following a Summary Review to consider the Interim Steps imposed, and whether they should continue, and until when;
  • The Licensing Authority, having the power to suspend, for up to 6 months, or revoke a Personal Licence upon it becoming aware a Personal Licence Holder has been convicted of a relevant offence.

We still await the date when changes will be made to put Cumulative Impact Policies onto a Statutory footing, and to provide greater flexibility for the use of Late Night Levies.”
