News: Offshore Remote Gambling Proposals

You will recall my eNews of 8th July 2011 reporting that new rules were being considered by the UK Government to regulate offshore gambling regulations.
Yesterday, the Minister for Tourism and Heritage, John Penrose made a written statement to Parliament officially placing his proposals on remote gambling on the record.
The proposals are to amend the Gambling Act 2005 so that remote gambling operators anywhere in the world, will be required to hold a Gambling Commission licence if they wish to operate or advertise in the UK. This is in addition to any other legislative regulation required from wherever these companies are based.
Clearly, an amendment of primary legislation will be required and in due course, Britain's white list will be made redundant.
It is further proposed that a transition period will be adopted to ensure that offshore operators in EEA member states and Britain's white list will be eligible for an automatic transitional licence.
Effectively, this will mean that all offshore operators operating in the UK would not be able to operate or advertise their services without being subject to the Gambling Commission regulation if the proposal becomes law.
